1. ACCEPTANCE OF TERMS

By accessing or using Dollar Pong (the "Platform"), creating an account, depositing funds, or participating in any competition, you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service and User Agreement (the "Terms"). If you do not agree to these Terms, you must not access or use the Platform.

We reserve the right to modify these Terms at any time. Material changes will be posted on the Platform, and your continued use of the Platform after such changes constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.


2. NATURE OF THE PLATFORM — SKILL-BASED GAMING

2.1 Skill-Based Competition

Dollar Pong is a peer-to-peer, real-time skill-based gaming platform. All competitions on the Platform are games of skill, not games of chance. The outcome of every match is determined exclusively by the players' hand-eye coordination, reaction time, strategic positioning, and motor control. There are no random elements, dice rolls, card shuffles, random number generators, or any mechanism of chance involved in gameplay.

2.2 Game Mechanics

Dollar Pong is a real-time multiplayer paddle game in which two players compete head-to-head. Each player controls a paddle using touch or mouse input to deflect a ball past their opponent's paddle. The first player to reach 5 points wins the match. The ball's trajectory is determined entirely by physics-based calculations derived from the angle and position of paddle contact. There is no randomness in ball behavior, spawn position, speed variation, or any other game element.

2.3 No House Advantage

Dollar Pong does not participate as a player in any competition. The Platform serves solely as a neutral venue that facilitates peer-to-peer matches. There is no house edge, rake, or algorithmic advantage favoring any party. The entire entry fee pool is awarded to the winning player. There is no platform fee on match winnings.

2.4 Legal Classification

Skill-based competitions with entry fees are legally distinct from gambling under the laws of the majority of U.S. states. Dollar Pong operates in accordance with the "predominant factor" test and "material element" test used by courts to distinguish skill-based games from games of chance.


3. ELIGIBILITY

3.1 Age Requirement

You must be at least eighteen (18) years of age (or the age of majority in your jurisdiction, whichever is greater) to create an account, deposit funds, or participate in cash competitions on the Platform.

3.2 Geographic Restrictions

Cash competitions on Dollar Pong are not available to users physically located in the following U.S. states, where state law restricts or prohibits skill-based gaming with entry fees:

These states are collectively referred to as "Restricted Jurisdictions." The Platform uses IP-based geolocation and may request browser-based location verification to determine your physical location. If you are located in a Restricted Jurisdiction, you may access the Platform and play practice (non-cash) games, but you may not deposit funds, enter cash competitions, or withdraw winnings.

3.3 Your Responsibility

You are solely responsible for determining whether your participation in cash competitions is lawful in your jurisdiction. The Platform makes no representation or warranty regarding the legality of your participation. Competitions are void where prohibited or restricted by applicable law.

3.4 One Account Per Person

Each individual may maintain only one account on the Platform. Creating multiple accounts, sharing accounts, or allowing another person to access your account is prohibited and may result in immediate termination and forfeiture of funds.


4. ACCOUNT REGISTRATION

When you create an account, you must provide accurate, current, and complete information. You are responsible for maintaining the accuracy of your account information and for all activity that occurs under your account. You are responsible for maintaining the confidentiality of your login credentials and must notify us immediately of any unauthorized use.

We reserve the right to request identity verification at any time, including but not limited to before processing withdrawals. Failure to provide satisfactory identification may result in suspension of your account and delay or denial of withdrawal requests.


5. DEPOSITS AND PAYMENTS

Deposits to your Dollar Pong account are made in U.S. Dollars (USD) via credit card, debit card, Apple Pay, or Google Pay through our third-party payment processing partner. By making a deposit, you represent that you are the authorized holder of the payment method used.

Deposits are processed by a third-party payment provider and are subject to that provider's terms and conditions. Deposits are generally credited to your account within minutes of successful payment processing. All deposits are non-refundable except as required by applicable law.


6. WITHDRAWALS

6.1 IMPORTANT NOTICE — USDC-ONLY WITHDRAWALS

BY DEPOSITING FUNDS AND USING THIS PLATFORM, YOU ACKNOWLEDGE AND AGREE THAT ALL WITHDRAWALS ARE PROCESSED EXCLUSIVELY IN USDC (USD COIN), A DOLLAR-PEGGED STABLECOIN, ON THE POLYGON BLOCKCHAIN NETWORK.

This means:

  • You will not receive U.S. Dollars (or any fiat currency) directly to your bank account, credit card, or any traditional financial account.
  • You must provide a valid cryptocurrency wallet address compatible with the Polygon network and capable of receiving USDC tokens (e.g., MetaMask, Coinbase Wallet, Phantom).
  • Converting USDC to U.S. Dollars is your sole responsibility. You will need to transfer USDC to a cryptocurrency exchange (such as Coinbase, Kraken, or Binance.US), sell the USDC for USD, and withdraw to your bank.
  • Dollar Pong is not responsible for any fees, delays, or losses incurred during USDC-to-USD conversion.

6.2 PLATFORM WITHDRAWAL FEE — 20%

A PLATFORM FEE OF TWENTY PERCENT (20%) IS DEDUCTED FROM ALL WITHDRAWAL AMOUNTS.

For example, if you request a withdrawal of $100.00, the platform fee of $20.00 will be deducted, and you will receive $80.00 in USDC on the Polygon network.

There is no platform fee on match winnings. The winner of each match receives the full entry fee pool ($2 for a $1 match). The 20% fee applies only at the time of withdrawal.

6.3 USDC Value

USDC (USD Coin) is a stablecoin issued by Circle and is designed to maintain a 1:1 peg with the U.S. Dollar. However, Dollar Pong does not guarantee that 1 USDC will always equal $1.00 USD. The value of USDC is determined by market conditions and the policies of its issuer. You acknowledge and accept the risk that the value of USDC may fluctuate.

6.4 Withdrawal Process

To request a withdrawal, you must:

  1. Navigate to the Wallet section and select "Withdraw."
  2. Enter the amount you wish to withdraw (minimum $20).
  3. Provide a valid Polygon-compatible wallet address to receive USDC.
  4. Review the 20% fee breakdown and confirm the withdrawal request.

6.5 Withdrawal Processing Time

Withdrawal requests are reviewed manually and generally processed within 96 hours of submission. We reserve the right to delay processing for identity verification, fraud investigation, or compliance with applicable law.

6.6 Incorrect Wallet Address

You are solely responsible for providing the correct wallet address. Cryptocurrency transactions are irreversible. If you provide an incorrect, incompatible, or invalid wallet address, your funds may be permanently lost, and Dollar Pong shall have no obligation to recover or refund such funds.


7. ACCOUNT BALANCES

Your account balance represents credits on the Platform denominated in U.S. Dollar equivalents. Your account balance is not a bank account, deposit account, or any form of stored value regulated under state or federal banking laws. Dollar Pong is not a bank, money transmitter, or financial institution. No interest is earned or accrued on your account balance.

If your account is inactive (no competition entry or deposit) for twelve (12) consecutive months, we reserve the right to charge a monthly maintenance fee of $1.00 or close your account. You will be notified by email before any maintenance fee is charged or account closure occurs.


8. COMPETITIONS AND GAMEPLAY

To enter a cash competition, you must have a sufficient account balance to cover the entry fee ($1). Entry fees are deducted from your account balance at the time you are matched with an opponent. The winner receives the combined entry fees of both players ($2). Winnings are credited to the winner's account balance immediately upon completion of the match.

If a player disconnects during a competition, the Platform will attempt to allow reconnection within a reasonable time (10 seconds). If reconnection is not possible, the match may be forfeited. All competition results are determined by the Platform's server-side game logic and are final.


9. PROHIBITED CONDUCT

You agree not to:

  • Use any automated software, bots, scripts, or other mechanical means to play competitions.
  • Collude with other players, including intentionally losing matches to transfer funds.
  • Create or use multiple accounts.
  • Exploit any bug, glitch, or vulnerability in the Platform's software.
  • Engage in any form of fraud, money laundering, or other illegal activity.
  • Attempt to circumvent geographic restrictions or age verification.
  • Use the Platform from a Restricted Jurisdiction for cash competitions.

10. DISCLAIMERS AND LIMITATION OF LIABILITY

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE MAKE NO REPRESENTATION OR WARRANTY THAT YOUR USE OF THE PLATFORM OR PARTICIPATION IN COMPETITIONS IS LAWFUL IN YOUR JURISDICTION.

YOU ACKNOWLEDGE THAT CRYPTOCURRENCY (INCLUDING USDC) INVOLVES INHERENT RISKS, INCLUDING BUT NOT LIMITED TO PRICE VOLATILITY, REGULATORY UNCERTAINTY, TECHNOLOGICAL VULNERABILITIES, AND THE POTENTIAL FOR PERMANENT LOSS OF FUNDS DUE TO INCORRECT WALLET ADDRESSES OR NETWORK FAILURES. DOLLAR PONG IS NOT RESPONSIBLE FOR ANY LOSSES ARISING FROM THESE RISKS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOLLAR PONG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE DEPOSITED IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.


11. DISPUTE RESOLUTION

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANY DISPUTE ARISING OUT OF OR RELATING TO THESE TERMS SHALL BE RESOLVED BY BINDING ARBITRATION. YOU AND DOLLAR PONG AGREE TO WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION. EITHER PARTY MAY BRING AN INDIVIDUAL ACTION IN SMALL CLAIMS COURT.


12. TERMINATION

You may close your account at any time by contacting us. Upon account closure, you may request a withdrawal of your available balance in accordance with Section 6. We may suspend or terminate your account at any time, with or without cause, and with or without notice. If your account is terminated for violation of these Terms, your account balance may be forfeited.


13. GENERAL PROVISIONS

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms constitute the entire agreement between you and Dollar Pong regarding your use of the Platform.
